Terms of Service
Last updated October 24, 2026
These terms apply to everyone who uses Kept: the family who orders a memorial page, the friends who visit it and add to it, and anyone browsing this site. Kept is run by LateralTranslucence LLC (“Kept,” “we,” “us”). By using Kept, you agree to them.
What Kept is
We build a private memorial page from what the family gives us, host it behind a passphrase, and, when the order includes one, print a softcover book of the photos and memories people add. The plans and what each includes are on our home page.
Pages offered through a funeral home
Some funeral homes offer Kept under their own name. Those pages are still built, hosted and protected by Kept, and these terms apply to them. If the funeral home took payment, questions about the order and refunds go through them.
The family
The person who orders the page, or who the order names, is “the family” in these terms. The family:
- chooses who gets the page’s passphrase, and can change it at any time;
- gets an admin area, with its own passphrase, for removing anything on the page;
- decides when the book goes to print;
- is responsible for keeping the admin passphrase private.
When family members disagree
We follow the instructions of the person who placed the order. If a page came through a funeral home, the person the funeral home names counts as the family. We can’t settle disagreements between family members, but we can pause changes to a page while they’re worked out.
What you add
If you add a photo or a memory, it’s still yours. By adding it, you give Kept and the family permission to show it on the page, put it in the book and in copies of the page we make for the family, and make the copies needed to do that, like resized versions and backups. This permission lasts as long as the page is up, and for any book already printed.
Only add what you have the right to share. A photo someone else took may belong to them; see Copyright & Takedowns.
What isn’t allowed
Don’t add anything that:
- is unlawful, hateful, harassing or threatening;
- is sexually explicit, or shows violence;
- shares someone’s private information without their permission;
- you don’t have the right to share;
- advertises something, or is spam.
And don’t try to get around a page’s passphrase, reach a page you weren’t given, or interfere with how Kept works.
Taking things down
The family can remove anything on their page, at any time, for any reason. We can remove anything that breaks these terms, or that the law requires us to remove. Removed items are hidden at once and can be restored by the family; to have something deleted for good, write to us.
How long pages stay up
Every plan includes the first year from launch. After that, the family can keep the page up for $79 a year, or keep it up for good with a one-time payment of $249. We’ll email the family at least 30 days before the first year, or a paid year, ends. If they choose not to keep it up, we’ll send them a copy of every photo and memory on it before we take it down.
Before we take any page down, for any reason, we’ll email the family at least 30 days ahead and send them that copy. The family can also ask us at any time, at no cost, for a copy of every photo and memory on the page.
If Kept ever stops hosting pages, we’ll tell each family by email at least 30 days before, and send them that copy.
Payment
Prices are those on our site when the order is placed. If you order from us directly, we email you an invoice for the whole order, payable in full within 7 days, by card or bank transfer. Stripe takes the payment. Refunds are covered in our refund policy.
The book
The book is printed from the photos and memories on the page when the family tells us it’s ready. The family is sent a PDF proof to review. We won’t print until the family approves it. Extra copies need to be ordered before then; copies ordered after the book is printed are a new print run, priced separately. If a book arrives damaged or misprinted, see our refund policy.
Our promises, and their limits
We work hard to keep every page online, private and safe, but we can’t promise Kept will always be available or free of errors. It’s provided as it is. We recommend the family ask us for a copy of the page from time to time and keep it somewhere safe.
As far as the law allows, Kept isn’t responsible for indirect or consequential losses, and our total responsibility for any claim is limited to the amount paid for the order it concerns.
Changes to these terms
If we change these terms, we’ll post the new version here with its date, and tell families with a page up by email before a significant change takes effect.
The law that applies
These terms are governed by the laws of New Jersey, and any dispute will be handled in the courts of Hudson County, New Jersey.
